According to the report Miss Kelly was afflicted by a range of mental health issues, such as borderline personality disorders such as bulimia, anorexia and bulimia. She was also victimized by her husband and was an addict to drugs. Her symptoms were exacerbated by anxiety, stress and depression. She was also diagnosed with bipolar affective disorder and schizoaffective disorders.

Elayaperumal claims Medtronic discriminated against him in a deliberate way due to his race or national origin. He argues that Medtronic's low performance review in June 2000 and the inability to grant him certain project assignments were motivated by racism or national animus. Medtronic has not provided any evidence to show that its decisions were based upon these factors.
