However, the assessor feared that she could pose a danger to herself or others and was not convinced that she was competent to grant consent.

The assessor recommended that Miss Kelly should be held against the will of her. Miss Kelly was not keen to be admitted to a facility, so she called her psychiatrist, Dr Ramanathan Elayaperumal. He was a consultant psychiatrist at the Home Treatment Team of Essex Partnership NHS Foundation Trust.

In response to this suggestion In response to this recommendation Home Treatment Team conducted a thorough assessment of Miss Kelly's condition of mind and current functioning. The review included a comprehensive medical history as well as a physical examination. The review included a detailed psychological assessment, family therapy assessment, and a psychiatric diagnosis interview.

According to the report Miss Kelly was afflicted by a range of mental health issues, including the borderline personality disorder such as bulimia, anorexia and bulimia. She also had a history of drug misuse and domestic violence. Her symptoms were caused by anxiety, stress and depression. She was also diagnosed as having bipolar affective and schizoaffective disorder.

Elayaperumal claims that Medtronic intentionally denied him a job due to his race and nationality. He argues that Medtronic's low performance review in June 2000 as well as the inability to provide him with specific project assignments were influenced by racism or national origin animus. Medtronic has not provided any evidence that its decisions were based on these factors. Elayaperumal’s lower performance rating did not result in a reduction in his salary or benefits.
